Trainer Agreement: Professional Conduct, Insurance & Responsibility
This Trainer Agreement (“Agreement”) is made effective as of the date signed below by and between All in Motion, LLC (dba AIM Pro) (hereinafter, “AIM Pro”), located at 112 S Sangamon St, Lower Level, Chicago, IL 60607, and the undersigned trainer (hereinafter, “Trainer”).
This Agreement is in addition to, and does not replace, the Waiver, Hold Harmless & Release of Liability Agreement signed by the Trainer. By signing below, the Trainer acknowledges and agrees to the following additional terms and conditions of use of AIM Pro’s facilities:
1. Professional Conduct
The Trainer shall conduct themselves at all times in a professional, lawful, and ethical manner when using AIM Pro facilities. AIM Pro maintains a strict zero-tolerance policy prohibiting harassment, discrimination, sexual misconduct, assault, abuse, or any other inappropriate or unlawful behavior. Any violation of this policy shall constitute immediate grounds for termination of the Trainer’s right to access and use AIM Pro’s facilities.
2. Responsibility for Clients
The Trainer is solely and exclusively responsible for all aspects of their professional relationship and interactions with their clients, including, without limitation:

Programming, instruction, and supervision;

Client safety, conduct, and well-being; and
-
Compliance with all applicable local, state, and federal laws.
AIM Pro does not supervise, monitor, or control Trainer–client interactions and shall not be responsible or liable for any claims, damages, injuries, disputes, or allegations arising therefrom.
3. Insurance Requirement
The Trainer shall, at their sole cost and expense, procure and maintain at all times during the term of this Agreement a policy of professional liability insurance (including coverage for claims of misconduct and abuse, to the extent available) with limits of not less than $1,000,000 per occurrence and $2,000,000 in the aggregate, issued by a carrier licensed to do business in Illinois and reasonably acceptable to AIM Pro.
The Trainer shall provide AIM Pro with a current certificate of insurance naming All in Motion, LLC (dba AIM Pro) as an Additional Insured prior to using the facility and upon renewal of coverage.
4. Indemnification
The Trainer shall fully defend, indemnify, and hold harmless AIM Pro, its owners, members, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including attorneys’ fees) arising out of or related to:
(a) the Trainer’s acts, omissions, negligence, misconduct, or professional services;
(b) any claim of harassment, discrimination, or misconduct by the Trainer; or
(c) any dispute, claim, or injury involving the Trainer and their clients.
5. Notice of Incidents
The Trainer shall immediately notify AIM Pro in writing of any incident occurring at the facility involving:
Injury or illness of a client;

Allegations of misconduct, harassment, or discrimination;

Unsafe equipment conditions noticed by the Trainer; or
-
Any client complaint that could reasonably result in a claim or dispute.

Failure to promptly provide such notice shall itself constitute a material breach of this Agreement.
6. Facility Access Suspension & Termination
AIM Pro reserves the right, in its sole discretion, to suspend or revoke the Trainer’s access to the facility immediately if the Trainer violates any provision of this Agreement, the Waiver, Hold Harmless & Release of Liability Agreement, or any posted AIM Pro policies. No refunds, credits, or compensation shall be due to the Trainer for any unused time, sessions, or reservations in the event of such suspension or termination.
7. Client Waivers
The Trainer shall ensure that each of their clients signs AIM Pro’s Waiver, Hold Harmless & Release of Liability Agreement prior to participating in any training session at AIM Pro facilities. Trainers are responsible for verifying compliance and may not conduct sessions with clients who have not executed the required waiver.
8. Credit Card on File & Billing
The Trainer must maintain a valid credit card on file with AIM Pro to remain active in AIM Pro’s booking and scheduling system. This card will be used for billing Premium/Peak Session charges and any other applicable fees.

Charges will be applied after the end of each calendar month for all peak-time usage and related fees incurred during that month.

If the Trainer fails to keep an active card on file, AIM Pro reserves the right to suspend booking privileges until payment information is updated.

All charges are non-refundable once processed.

Acknowledgment
By checking the box in your registration you are acknowledging: I have read, understood, and agree to abide by the Rules, Policies, and Procedures of All in Motion, LLC (dba AIM Pro). I understand that failure to comply may result in termination of rental privileges.
